Can I sell an inherited mobile home in Tennessee?
Usually yes, but the order matters. Authority to sign comes before price, and getting that backwards is what stalls these for months.
The title is still in the deceased owner's name
This is the usual starting point. A title cannot be signed over by somebody who has passed away, so the question becomes who has legal authority to sign for the estate. Depending on the situation that can be an executor or personal representative, or it can require a probate step. Tennessee also has simplified paths for small estates in some cases.
This is a question for a Tennessee attorney or the probate court clerk in the county where the person lived. We can work around a lot of things, but we cannot tell you who has authority to sign.
Multiple heirs
Three siblings who all agree still means three signatures, three schedules, and often three different ideas about what the home is worth. Three siblings who do not agree means the process pauses until they do.
The most useful thing you can do early is find out who the interested parties are and get one person designated to talk to buyers. Deals fall apart from crossed wires far more often than from price.
The home is on family land
Frequently the home is on land that was inherited too, sometimes by different people than the home, and sometimes by everyone together. Whether the home stays or goes, and who has the right to decide, has to be settled before a sale is real.
Also check whether the home was ever affixed to that land, because if it was, it may be part of the real estate rather than titled property.
Unknown liens and missing paperwork
Older relatives' homes often have loans nobody knew about, or loans that were paid but never released. There may be back property taxes on the land, or back lot rent if the home is in a park.
None of this is unusual, and none of it means the home cannot be sold. It just means somebody has to make the phone calls, and the sooner that starts the better.
- Search for the title certificate and any loan paperwork
- Check with the county trustee for unpaid property taxes
- Ask the park for a current lot rent statement
- Ask the county clerk what the title record shows
- Find the will or ask the probate clerk what has been filed
